Regulation of Nurseries in Companies

The Salvadoran government announced that in January 2020 it will submit a proposal to regulate the operation of nurseries dedicated to the care of employees' children, which will be mandatory for companies with more than 100 workers.

The regulation will be part of the application of the Special Law for the Regulation of Nurseries, which will enter into force on June 19, 2020.

The regulation will include elements such as the profile of those responsible for supervising minors, infrastructure requirements, as well as possible mechanisms to alleviate the economic burden that currently falls on businessmen, according to an official statement.

Laprensagrafica.com reports that "... The company has three options: install its own nursery, create one in conjunction with others in the area or hire a third party. The regulation is necessary because it will establish specific operating parameters. For example, the law says that the caring place must be in the 'territorial circumscription', but does not specify the distance or whether it refers to the same municipality.

The article adds that "... The nurseries are a right that can be demanded by both the father and the mother when the baby is more than four months old and up to three years old. The four months were established because before the mother can take the time; however, if this one has died, the father can make the requirement from before."
