Pharmaceutical Companies Sanctioned in El Salvador

American Drugstore and C. Imberton were sanctioned for proving "that they engaged in the anti-competitive practice of agreeing to fix the prices of Cataflam, Diovan and Lamisil products."

The Superintendence of Competition of El Salvador (SC) sanctioned American Drugstore, for $171,000, and C. Imberton, for $228,000, after proving that they engaged in the anticompetitive practice of agreeing to fix the prices of the products concerned, informed the institution.

San Salvador, May 17, 2019. The societies Droguería Americana, S. A. de C. V. and C. Imberton, S. A. de C. V. committed the anticompetitive practice typified in art. 25, letter a) of the Competition Law (LC), after agreeing to fix the gross sale price in the wholesale distribution market of Cataflam medicines oral suspension 9 Mg. 120 Ml. x 1 (5ml.), Diovan capsules 160 Mg. x 14, and Lamisil tablets 250 Mg. x 28, produced by the pharmaceutical laboratory Novartis, Pharma (Logistics). 


This sanctioning procedure originated after the previous proceedings started in 2013, from the notification of the National Directorate of Medicines about alleged irregularities in the wholesale prices of Cataflam, Diovan and Lamisil. The foregoing, within the framework of the entry into force of the Law on Medicines (LM) and the Regulation for the determination of maximum retail prices (PMVP) of medicines and their verification.

Droguería Americana, S.A. de C.V. and C. Imberton, S.A. de C.V., are under investigation for allegedly agreeing on pricing and division of customers relating to the distribution of three medicines nationwide.

The companies investigated are alleged to have agreed to fix prices and divide up customers in relation to distribution of the medicines Cataflam Oral Suspesion 9 Mg. 120 Mil x 1 (5ml) - an antiinflammatory and antirheumatic-, Diovan Capsules. 160 Mg x 14 - related to the cardiovascular system - and Lamisil Tablets 250 Mg. X 28 - topical antifungals used in dermatology.

The penalty imposed by the Commission to Promote Competition in Costa Rica has been upheld after the First Chamber of the Supreme Court declared the last appeal filed by the company irrelevant.

The penalty for monopolistic practices, dating back to May 2004 was because the bottler apparently made exclusive contracts with vendors and fixed prices.

Honduran Sugar Producers Sanctioned for Anti-Competitive Practices

March 2011

Six of the seven sugar mills operating in Honduras were fined a total of $ 3.2 million for monopolistic practices.

These are Chumbagua mills, CAHS, Yojoa, Choluteca, La Grecia and Tres Valles.

Elheraldo.hn published, "The penalty responds to violations of the Competition Law, specifically regarding Article 5, paragraph 1, which prohibits contracts, agreements, concerted practices, combinations or arrangements between competitors or competing operators with the purpose of establishing prices, fees or discounts."
