Panama: Discussion on Free Parking Postponed

A bill to grant the right to park for free at in shopping center parking lots will be discussed in a second debate in January 2015.

Having been approved on the first reading of Law 45 of 2007, it was expected that the second debate would he held before the start of the new regular session, but in the end it was decided to postpone it and include it in the legislative agenda of January 2015.

Panamaamerica.com.pa reports that "... The bill, introduced by Representative Leandro Avila, offers to ease the burden that has arisen from parking payments by consumers and users of shops and places where services are offered. "

'... This project seeks to establish clearly the responsibility that corresponds to establishments engaged exclusively in the business of leasing or renting parking. "

With opposition from the business sector and partially vetoed by President Varela, the Assembly has approved the law granting the right to free parking in shopping centers.

Now it will be the Supreme Court which decides whether the controversial law adopted in January and subsequently vetoed in two articles by President Varela, is not unconstitutional.

Despite opposition from the business sector, a law has been approved on its third reading which requires businesses to provide their customers with free parking for the first three hours of their stay.

The business sector claims that the bill regulating the use of parking lots in shopping malls and public offices goes against private enterprise and sends signals of legal uncertainty.  

The approval on its first reading of the amendment to Act 45 of 2007 which dictates measures on the rights of consumers related to the use of parking lots in shopping malls and public offices has been opposed by the private sector.
