Litigation Over Land Use in Obarrio

The Supreme Court has temporarily suspended a Miviot resolution approving the zoning change to "high density" in Obarrio, Bella Vista.

The change in the zoning code for 42 lots in Obarrio had been authorized by the Ministry of Housing and Land Management (Miviot) in March, and made the change from low to medium density, to residential "high density" and "urban commercial mixed high density".

According to the ruling given by the Third Chamber of Administrative Litigation, which came after the Mayor of Panama filed a petition for annulment against the decision by the Miviot, "... the effects of the resolution of the Miviot could produce potential injury to the legal system and an 'serious' affectation to the general interest. " adds that "...The Third Chamber argues that the appeal lodged by Blandon has a reasonable semblance of a legal basis, which allows for the appreciation of a possibly injured right. In the arguments presented to the Court by the mayoral office it was mentioned that the contested administrative act violates the existing law in a 'manifest' and 'notorious' manner, as the Miviot approved the changes in zoning or land use in the local environment, resulting in a direct affect on a specific sector in the district of Panama."
