US - Costa Rica Tax Information Exchange

Under the new agreement, information will be exchanged in order to determine, settle and collect taxes, as well as collect and execute tax claims.

The renegotiation of this agreement, initially signed in 1989 and in force since 1991, began in September 2014 and ended in the first quarter of 2018.  

From a statement issued by the Ministry of Finance in Costa Rica:

April 20, 2018. In order to meet the current standard of fiscal transparency established by the Organization for Economic Cooperation and Development (OECD) regarding the exchange of information for tax purposes and mutual assistance, and once the renegotiation process has concluded, representatives of the Governments of Costa Rica and the United States signed a new agreement this week for the exchange of information between both countries.

The agreement was signed by the President of the Republic, Luis Guillermo Solís Rivera, and the Ambassador of the United States, Sharon Day, and must be submitted to the Legislative Assembly for ratification. 

Under this agreement, both countries will offer assistance through the exchange of information in order to determine, settle and collect taxes, as well as to collect and execute tax claims, or to investigate or prosecute tax matters.  All this information will be treated confidentially between both parties

Tax Data: Agreement Between Costa Rica and the U.S.A.

In order to update the Intergovernmental Agreement for the Effectiveness of the Tax Compliance Law on Foreign Accounts, signed by both parties in 2013, the governments of both countries signed a complementary agreement to FATCA.

According to the Ministry of Finance of Costa Rica, with the subscription of the complementary agreement, the legal basis of the FATCA (Foreign Account Tax Compliance Act) will be updated with the provisions of the Agreement with the Government of the United States of America for the exchange of information on tax matters, which will enter into force next September.

The agreement with the OECD allows the automatic exchange of tax information to be made bilaterally.

The Government of Panama signed today in Paris the Convention on Mutual Administrative Assistance in Tax Matters (MAC), a definitive step in updating and transforming the country’s international financial services platform.

Tax Convention Costa Rica - Mexico

May 2012

In Costa Rica an agreement with the United Mexican States on the Exchange of Information in Tax Matters is in force.

From la Gaceta 101 of 25 May 2012:

PURPOSE AND SCOPE OF AGREEMENT

The competent authorities of the Contracting Parties will provide assistance through exchange of information that is foreseeably relevant to the administration and enforcement of domestic law with respect to taxes or tariffs covered by this Agreement. The information will include such things as is foreseeably relevant to the determination, assessment and collection of such tax or tariffs, for the collection and enforcement of tax claims or investigation or prosecution of tax matters.

Costa Rica Will Exchange Tax Information With Argentina

November 2009

The objective of the agreement signed between Costa Rica and Argentina is to fight tax fraud and fiscal evasion.

Both countries will exchange fiscal information in a wide array of forms and subjects.

Jenny Phillips, Treasury Minister, told Elfinancierocr.com: "Given the current global economic reality, it is crucial to exchange tax information between countries, to be able to comply with fiscal requirements imposed by the international community".
