Illegalities in Tender for Work Equipment Denounced

The union of distributors of equipment in Panama has denounced the existence of illegal requirements in the specifications of a tender to provide motor graders.

The Association of Machinery Distributors (Adimaq) argues that the request for proposal documents for best value tender No. 2016-0-16-0-08-LV -011526 to supply 15 motor graders included "... in an illegal manner, new conditions for sanctions and disqualifications after legal compliance, thus violating Public Procurement Law 22 of June 27, 2006. "

The executive director of Adimaq, Javier Zamorano, told that "..."It is a violation of the law to attempt through the request for proposal documents to say that conditions for disqualification pre-exist even after its legal extinction. It's a double penalty because the company sanctioned makes a payment for a fine, is disqualified and now can not participate in the process.' "

The representative of the Guild of Machinery Companies stated that in the request for proposals the equipment specifications are not standardized but rather other illegal ones are established, which also restricts competition.
