Heavy Transport: Extension Requested for Speed Control

In Guatemala, transporters are asking to postpone the entry into force of the rule that establishes that vehicles of 3.5 tons and 12 passengers and above must install a device that will report the speed at which they circulate.

The regulation in Governmental Agreement 38-2019, published in April of this year, establishes that as of November 14 heavy transport units must carry a device that will have the function of measuring the speed at which vehicles travel, which must not exceed 80 kilometers per hour.

The National Transport Coordinator (CNT) believes that this rule is anti-technical and threatens to carry out a strike if the agreement becomes effective without first establishing a technical roundtable to evaluate the application of the measures that are intended to impose.

Hector Fajardo, representative of the CNT, told Elperiodico.com.gt that "... they agree not to exceed the speed established in the Transit Law, 80 kilometers per hour, but not that the devices are installed in the transport equipment, since these do not work on descent slopes."

Fajardo added that "... the regulation affects the vehicle fleet of 3.5 tons and 12 passengers and above. He said that in August in the Superintendence of Tax Administration (SAT) were registered 273,596 vehicles, 7.43 percent of the total vehicle fleet."

The transporters said that for now Provial has only authorized 45 companies to implement the system.

Heavy Transport: Excess Cargo Sanctions

Cargo Transport: Fines Canceled

The Constitutional Court revoked the $260 fine that the municipality of Guatemala would charge to heavy vehicles and double trailers that travel through the city in unauthorized hours, so now the penalty will be $65.

The action of unconstitutionality was brought to the Constitutional Court by the Central American Federation of Transportation (FECATRANS) and the National Coordinating Association of Transport, against Article 4 of Agreement COM-13-2016 of the Municipal Council of Guatemala.

Truck Drivers Complain Insurance is Unfair

Mexico and Guatemala have agreed a policy whereby trucks entering the Guatemalan border zone pay $970, a charge that the union considers "harmful" and that is not reciprocal.

The International Transporters' Association (ITA) will challenge the agreement which regulates transportation of cargo and passengers across the border, considering it "harmful to the interests of the country (Guatemala)", reported the newspaper Prensa Libre on its website.
