Free zones: Reforms Stagnate

Two years after having been presented at the Guatemalan Congress, the initiative to reform the Free Zones Law is still awaiting approval.

In 2016, initiative 5174 was presented to the Congress of the Republic, and has been debated in speeches made by deputies and in meetings of the Economic Cabinet of the Executive Power, none of which have resulted in its approval.

One of the biggest obstacles that the initiative faces is that the deputies requested that the proposal be modified, since, in the opinion of the legislators, the fiscal losses that would be caused by the law reform as it is currently proposed must be reduced.

In regards to this topic Acisclo Valladares, Minister of Economy, explained to Elperiodico.com.gt that " ... he is still working to present a concrete initiative to the Congress. The proposal said that the balance of "generation of employment, without opening up a fiscal gap" should be made by proposing the necessary locks."

Valladares added that " ...The modifications would include locks so that companies that are already operating and contributing to the treasury do not change their regime and that the free zones do not operate as fiscal warehouses, for example." 

The article reports that "... Although the proposed reform of the Free Zones Law is part of a package of laws that the Executive considers are a priority for reactivating the economy, it will depend on speed, in order to present the modification that has been sought for almost five months and the time for discussion and approval in Congress. If it happens before the end of the legislative period in November, the changes will have an impact on the fiscal estimates for 2019."

Honduras: Reform to the Free Zones Law

December 2019

With the reform proposal to the Law of Free Zones presented to Congress, it is intended to reduce from 20 to 10 the requirements that must be met to approve a new free zone.

After several months of working on the proposal to make changes to the law, the file was submitted to the legislative chamber and prepared by the Honduran Maquiladora Association (AHM), the Ministry of Finance, the Central Bank of Honduras and the Ministry of Economic Development (SDE).

El Salvador: Veto of Free Zone Law Reform

Nayib Bukele returned to the Legislative Assembly the reform to the law of Free Zones that granted tax benefits for an additional period of 10 years to companies in the country to increase their investment in 100% with respect to the initially made.

On August 29, 2019, the Assembly informed that the Legislative Plenum endorsed the reform to the Law of Industrial and Commercial Free Zones, establishing that the users of these zones would have a term of 10 additional years (before there were five) to continue enjoying total exemption from taxes, which would be applicable once the period established for the regular enjoyment of this benefit expired.

Free Trade Zones at risk?

December 2018

Since the free trade zones law was amended, almost 100 companies have closed in Guatemala in the last two years, and by 2019 the figure is expected to keep growing if the regulatory framework is not modified.

Data from the Bank of Guatemala detail that from January to October of this year, exports of companies in free trade zones totaled $471 million, 2% less than the $479 million registered in the first ten months of 2017.

How to Improve Investment Promotion

July 2018

A bill by the Morales administration in Guatemala proposes creating an agency that would manage issues of commercial promotion, competitiveness, investment attraction and country brand.

Representatives from the Ministry of Economy presented in Congress a proposal for a Law to create the Institute for Commercial Promotion, ProGuatemala, which would absorb the functions and staff that at the moment execute the National Program of Competitiveness.
