Costa Rica: Seed Registration

Registration procedures have been updated for the commercialization of new seed varieties.

From a statement issued by the Ministry of Agriculture:

An executive decree recently published in La Gaceta, regulates the procedure for the registration of new varieties for commercialization, whose implementation, for 40 years, has been the responsibility of the National Seed Office (ONS by its initials in Spanish), in order to minimize the risks in Production and promote healthy trade among seed trading companies. The Decree is number 40300-MAG, published on April 26, of this year, in La Gaceta No. 78.

"The decree is in effect for marketing companies that work in the formal market and seeks to protect producers who acquire seeds in the agribusiness, guaranteeing that the variety they acquire has been previously evaluated, verifying their adaptation and behavior in the locations where they are going to be used," explained Walter Quirós, Executive Director of the ONS.

The Government's decision has set a healthy precedent. The Ministry of Health has announced that it has replaced the obsolete regulations and lengthy formalities for registration of natural products, supplements and foods, with three requirements which must be submitted: "An affidavit where the company assures the characteristics of the product and meets the standards of the General Health Law, on labeling and a certificate of free sale or a health permit, depending on the origin of manufacture." With this it has been found that the state can fulfill its role of protecting the safety of citizens and at the same time establish a legal framework that is friendly to investment.

Since 1960 the import, distribution and marketing of seeds has been regulated by a ministerial agreement, the new proposal, which has the support of the United Nations Organization for Food and Agriculture (FAO) and the Spanish International cooperation Agency for Development promotes the formation of local companies o as to be able to have reserves in critical situations.
