Claim for Debt on Behalf of Florida Ice & Farm Suspended

The Costa Rican Constitutional Court accepted an appeal filed by the company La Florida SA, a subsidiary of Fifco, against IDA (Agrarian Development Institute) and the Administrative Fiscal Court.

Mercedes Agüero wrote in "The company asked the judges to overrule the resolutions by the Administrative Fiscal Court which held in favor of IDA. 'We are receiving a positive response from the Constitutional Court that, in addition to hearing the appeal, collection of the debt is being suspended,' said Gisela Sanchez, director of corporate relations for Florida."

Guatemala: There will be No Exemptions from Fines

President Otto Perez Molina will not grant exemptions from fines imposed by the Tax Authority.

An article in reports that "The President has asked the General Secretariat of the President to address the 202 cases presented by businessmen, politicians and figureheads." The SAT in Guatemala could temporarily suspend for 12 consecutive months companies that do not report any activity on their tax returns.

This action by the Tax Authority was approved by a resolution passed this week by the board of the entity.

The Superintendence of Tax Administration (SAT) estimates that $ 449 million is owed in taxes and $ 256 million in penalties and interest.

The Costa Rican Institute of Agrarian Development (IDA) is trying to charge this sum as the principal and interest on a debt acculumated through unpaid taxes.

IDA law establishes a tax of 5% on foreign and national beer and the differences in the manner of calculating the total amounts of previous years have motivated litigation and brought on the current situation.
