$90 million Law Suit Against Costa Rican State

The concessionaire of the route San Jose – Caldera, , Autopistas del Sol, has filed a lawsuit against the state demanding an update of the cost of road construction.

The company is seeking to "rebalance the contract based solely on an update of the amount of the original bid", said Luis Diego Flores, constitutional attorney. The concessionaire maintains that the cost of the works exceeded the figures set out in the original bid for the project.

"In order to make a claim over the money, Autopistas del Sol requested that an arbitration process be opened at the International Center for Conciliation and Arbitration of the American Chamber of Commerce (CICA). The process was raised in September 2011, but yesterday it was revealed that an appointment had been made by the Attorney General's Office for representation and defense of the State", reported Nacion.com.

The lawsuit filed last year was against the National Tender Board. By decree the Presidency and the Ministry of Public Works included State representation at the Attorney General's Office which has already submitted its responses. The results are expected within six months.

State of Guatemala Wins Arbitration Against Iberdrola

August 2012

The International Centre for Settlement of Investment Disputes (ICSID) of the World Bank, has ruled against the claim of the Spanish company Iberdrola against the State of Guatemala.

The lawsuit filed by Iberdrola, a major shareholder and operator of the Empresa Electrica de Guatemala (EEGSA), in late 2009, was due to a disagreement on the rate of Value Added Distribution (VAD), in force since August 2008.

Costa Rica: Autopistas del Sol Sued

October 2010

The company, who holds concession of the San José-Caldera highway, is facing a lawsuit for $ 1.1 million in environmental damages.

The areas affected are between Ciudad Colón and Orotina.

"In that 39 km stretch there are clogged streams, small streams and slopes covered with debris and soil removed during construction of the road." informed Nacion.com.
