From February 1 until July 31 private companies that recognize contributions owed to the Social Security Institute will be exonerated from the 100% penalty charges.

The Superintendent of Tax Administration has contradicted the announcement made by the finance minister and ruled out a possible tax amnesty in the short term.
The highest tax authorities in Guatemala are contradicting each other. Although the minister of Finance, Julio Héctor Estrada, announced a possible tax amnesty for the second half of this year, Juan Francisco Solórzano Foppa, head of the Tax Authority (SAT) said in remarks published by Elperiodico.com.gt that "there will not be a tax amnesty".
A grace period has been granted up until October 5, 2015, for filing in the tax return without penalties charged for delays.

Decree No. 66-2015, which extends the amnesty provided for in 140-2014, was recently approved, by which 60 calendar days are granted from the day following the publication in La Gaceta, in order for tax declarations to be settled without incurring penalties from the Executive Management and Revenue (DEI).
A constitutional court has suspended the validity of the transitional law passed in early October which allowed delinquent taxpayers to request a payment plan of up to six months.

The Ministry of Finance, through the General Directorate of Internal Revenue, Treasury Department and the General Customs Directorate, wishes to report to all taxpayers:
A waiver of fines, interest and penalties will apply starting June 12th and will run for 90 days for all taxpayers, both natural or legal persons.
Government Agreement No. 174-2014 published in Diario de Centroamérica:
"Article 7. Transient. Regularization. Taxpayers from the term of this Agreement, who elect to regularize operations or modify the method of recording costs and expenses, under this agreement, though the application of the special treatment provided therein and who owe taxes or formal sanctions, may enjoy exemptions from penalties, interest or surcharges in the method set out in this article. "
Business leaders say that amnesties on tax debts are an unjust punishment for companies that meet their tax obligations on time.
Private enterprises have criticized the inconsistency of state powers who on the one hand are seeking to increase revenue and on the other, reward and promote the culture of "no pay", stating that tax amnesties do not benefit the country.
The National Revenue Authority plans to raise $400 million from taxpayers who will be allowed to regularize their tax status under the Tax Adjustment Act.
Prensa.com reports that "In addition to the so-called regularization or tax amnesty, the law establishes a moratorium for taxpayers who are delinquent in any taxes administered by the Anip. The persons (natural or legal) may pay the debt, free of fines, surcharges and save 25% on the interest earned. "
Congress has approved giving amnesty to tax debtors and extended to $80 thousand the ceiling for housing loans with preferential interest rates of 4%.

The National Assembly approved on the third reading, Bill numbers 627 and 628, the first of which grants taxpayers the opportunity to regularize their tax obligations with the National Revenue Authority (ANIP), while the second, amends Article 5 of Law No. 3 of 1985, which establishes a preferential interest rate on certain mortgage loans.
A bill intends to give taxpayers the opportunity to get in order tax payments owed due to errors or inaccuracies up to the fiscal year 2011.

The amnesty includes those who owe taxes for tax periods prior to 1 January 2012.
S21.com.gt reports that "this measure is complementary to the cancellation of 10% in tax payments and 50% reduction in the circulation tax".
"It was clear they had to agree to the waiver. Almost always a law produces the need for a government decision. It is estimated that $77 million is owed in taxes, of which, 65% relates to income tax.
They undermine the principle of tax justice and the morality of honest taxpayers, hindering equal competition and promoting impunity.

- The approved decree contains a greater amount of tax amnesty, in which benefits are given to delinquent taxpayers and those who have operated at unfair advantage over those who pay their taxes correctly and on time, even aggravating the negative consequences of the tax amnesty applied in 2011. This action violates the principle of tax justice and the morality of honest taxpayers, constituting an obstacle to a desirable climate of competition on equal terms, clear rules and ones which combat impunity.
The private sector in Honduras is protesting that the tax amnesty will not benefit small entrepreneurs .
In a letter sent by Mario Bustillo, director of the Chamber of Commerce and Industry of Tegucigalpa (CCIT) to the Finance Secretary, Wilfredo Cerrato, the official explained that persons and corporations whose declared gross income was lower than $1.57 million were excluded from the amnesty.
A law decree under discussion in Congress seeks to grant a tax amnesty on penalties and interest to taxpayers with outstanding accounts with the State.
