Panama: Law on State Purchases

Transparency International believes that the bill currently under discussion is insufficient to prevent corruption in the state procurement system.

According to the Panamanian chapter of Transparency International, the bill on public procurement in the country should include aspects such as making public the annual action plan to further reduce discretion to recruit directly, eliminating the possibility of "addenda which is harmful to the interests of the State " or improving the process of paying bills.

From a statement issued by Transparency International, Panama Chapter:

For two weeks, the Commission of Economy and Finance in the National Assembly listened to those interested in making contributions to bill 305 amending the only text of Law 22 of 2006 which regulates public procurement in Panama. Participants included representatives of civil society organizations, law firms, unions, companies and even different public institutions.

In the view of Transparency International, Panama Chapter, it is essential that the legislation reduces the risks that have allowed public procurement to be used for acts of corruption, for which it is necessary to deepen some aspects that bill 305 addresses in a very timid manner.

Changes to the management of "turnkey" contracts and elimination of abbreviated tenders are part of the changes included in the bill which has already been approved by the Executive in Panama.

The bill was sent by the government to the National Assembly, where it will be discussed for approval.

Martinelli's Changes to Procurement Law to be Appealed

The elimination of the abbreviated tenders is part of the search for greater transparency, although it will mean more red tape.

The first major change in the law is the elimination of the changes made to it during the Martinelli administration which will return the law practically to its original features.
