Guatemala: Court Rejects Bid for Candidacy by Former First Lady

Guatemala's Electoral Tribunal has rejected the registration for candidacy in the presidential election of Sandra Torres, who recently divorced from President Alvaro Colom.

According to an article in Prensalibre.com the Supreme Electoral Tribunal (TSE) ruling on the registry reads "Decision: Refusal of the application for registration of Ms. Sandra Torres Julieta Casanova, as a candidate for presidency of the Republic to which she cannot be elected to under the express prohibition contained in Article 186, paragraph c) of the Constitution and due to infringement of the law, as provided in Article 4 of the Judiciary Act ".

The resolution explained that Sandra Torres is prevented from proceeding because Article 186 of the Constitution prohibits access to the presidency of the Republic to any relatives of the president and vice president in the fourth degree of consanguinity and second degree of affinity.

The ruling also is based on the fact that: "A divorce decree can never invalidate a restrictive and categorical ban" in the Constitution, citing the basis of Article 4 of the Judiciary Act, that it is "committing fraud, because the divorce that took place, in this case fully accomplished, had as its intent the evasion of the constitutional prohibition, with the aggravating circumstance that the law they tried to make a mockery of is the Constitution itself," alluding to statements by President Colom who admits he divorced Torres in order to facilitate her aspirations to the presidency.
