Changes to Regulation of Industrial Property in Guatemala

The changes include modifying records for geographical indications and designations of origin.

The Guatemalan Ministry of Economy has approved an amendment on the regulations in the Law on Industrial Property records, specifically relating to geographical indications and designations of origin.

"The specification must contain what is in Article 82 of the Law, also a description of the process of production, processing or extraction, indicating the general and specific factors detailing the components that affect, directly or indirectly, the quality or product characteristics ".

Among other things, there must be a "definition of the geographical area and its characteristics, indicating the relevant data such as altitudes, longitudes and latitudes, regions or places.

The requirements for geographical registration or designation of origin include "the identification of the applicant, protected logo and if it is a foreign country of origin, the product which will use it, and the date of resolution given by the Registry of Intellectual Property which confers its protection. "
