Food: New Rules for Exporting to the U.S.

Exporters are preparing for the new regulation that will be implemented from 2020 in the U.S. market, among which is the application of a new table of nutritional data in packaged products.

Representatives of the Guatemalan Association of Exporters (Agexport) reported that both U.S. and foreign companies exporting to the U.S., must comply with new food labeling standards.

Executives of the exporters' guild said that food companies with annual sales of more than $10 million will have until January 2020 to comply with the mandatory label. Companies that report annual sales of less than $10 million will have time until January 2021 to implement the regulations.

Regarding the controls of U.S. authorities, Inés Valle Balsells, analyst at the Market Intelligence Unit of Agexport, told Prensalibre.com that "... the Food and Drug Administration (FDA), has a system of "import alerts" or automatic detention lists."

Valle advised that "... Complying, with enough time, with the rules and regulations before exporting, will avoid inconveniences in customs such as detentions and rejection that can turn into destruction of the product or return of them causing monetary losses and a negative history to the exporting manufacturing companies before the FDA'."

The Food and Drug Administration (FDA) of the United States has finalized two regulations requiring the inclusion of calorie information on menus and menu boards in chain restaurants, similar retail food establishments and vending machines with 20 or more locations, in order to offer consumers greater nutritional information on food eaten outside of the home. The regulations are a requirement of the law on Affordable Health Care and Patient Protection 2010.

Technical Rules for Exporting Food and Beverages

November 2014

Training is being provided in Guatemala on Central American Technical Regulations for companies exporting food and beverages.

From a statement issued by the Guatemalan Exporters Association:

In order to expand knowledge and provide updates on general and nutritional labeling, and food additives for the processed foods and beverages industry, among other things; the Committee on Food and Beverages at AGEXPORT with support from the Department of Food Control Regulation of the Ministry of Health and Welfare, will be holding a training Workshop on Central American Technical Regulations (RTCA by its initials in Spanish).

Changes in U.S. Export Requirements

From March new requirements imposed by the Food and Drug Administration will be implemented progressively on food imported by the United States.
