Nacion.com reports that "...The case dates back to 2002 and relates to a BOT  - build, operate and transfer - contract signed between the ICE and the Spanish private generator to produce 50 Megawatts (MW) of energy with a water source in the canton of Turrialba."

"... In 2010, however, La Joya sued the ICE for $7.9 million seeking recognition of alleged overcharges which it may have incurred due to the suspension of the project, ordered by judicial and administrative authorities due to an impact on aquifers affected by the work."

"... With respect to the BOT contract and its nature, the Court recalled that in these projects "a total assumption of the risk is required by the builder not only in the design, execution and start-up of the work, but also in the exploitation of the work" the ICE said in a press release following resolution 67-2017-VIII of July 13, 2017."

Costa Rica: New 50 MW Hydroelectric Power Station

Operations have started at the Torito hydroelectric power plant, owned by the Spanish company Gas Natural Fenosa, which invested more than $190 million in the new plant .

The proposed construction and operation of the plant was awarded in 2008 by the Costa Rican Electricity Institute (ICE) to Gas Natural Fenosa, which will operate for a period of 20 years through its subsidiary Global Power Generation (GPG).

Construction of Hydroelectric Torito Starts in Costa Rica

Gas Natural Fenosa has begun construction of the hydroelectric dam Torito, which will have an installed power of 50 MW.

The project will use the waters of Reventazón and will be developed by the company Unión Fenosa Generadora Torito S. A. This is the second hydroelectric plant to be built by Gas Natural Fenosa in the Central American country.

The construction firm Copisa has been awarded the contract for construction of a hydroelectricity plant to generate electricity in Pavones, Turrialba in Costa Rica, on behalf of Union Fenosa Generadora Torito, this country’s subsidiary of the Gas Natural Fenosa group.
